Terms of Use
Food & Drink Diary · Last updated: 11 October 2026
Welcome to "Food & Drink Diary" (the app and the website, hereinafter: the "Service"). The Service is operated by Noa Eliaz, [Business ID / Company No.], 2 Weizmann St., Tel Aviv, Israel (hereinafter: "we"). These terms, together with the Privacy Policy, govern the use of the Service. By opening an account and using the Service, you confirm that you have read the terms and that you agree to them. If you do not agree, please do not use the Service. Anything stated in the masculine gender refers to all genders, and the headings are for convenience only.
1. The Service
The Service lets you log meals and drinks, calculates an estimate of nutritional values (calories, fat, carbohydrates, sugar, protein, saturated fat, dietary fiber, sodium and cholesterol), and displays summaries, charts, reports and a comparison with general daily recommendations. Among other things, the Service includes:
- Automatic breakdown of foods into values, using a shared food database and an artificial intelligence model (Claude, by Anthropic).
- Adding a packaged product by barcode, using the open database Open Food Facts and a shared barcode database.
- Logging by voice, using the speech recognition service of the browser or of the operating system.
- "My nutritionist": choosing a real nutritionist and being in contact with them (see section 4), and "AI nutritionist": general information and a menu from an artificial intelligence model (see section 5).
- An estimate of vitamins and minerals based on what you have eaten, drink reminders, a personal profile with a body mass index (BMI) calculation, reports to view, save and send, and a backup of the diary.
2. Who may use the Service
The Service is intended for persons aged 18 and over who have the legal capacity to enter into a binding contract, and you will be asked to confirm this when you register. Each account is intended for one person, for personal and non-commercial use. You undertake that the details you provide when registering are correct, and that you will not open more than one account in order to obtain an additional trial period.
3. This is not medical advice
- The nutritional values in the Service are estimates only. They are based on food composition databases, on typical recipes, on information provided by users and on a calculation by an artificial intelligence model, and may differ from the actual values, sometimes considerably. For a packaged product, the values on the packaging prevail.
- The estimate of vitamins and minerals is based on an estimate only, in the absence of a precise breakdown of all the components of the foods logged, and does not include dietary supplements. Your intake of vitamins and minerals should be assessed independently or with the help of a professional.
- The daily recommendations, the BMI and the drinking goals are general, are intended for healthy adults, and are not adapted to your medical condition. The BMI does not distinguish between muscle and fat, and is not a diagnostic tool.
- The Service is not medical, nutritional or therapeutic advice, is not a medical device and is not a substitute for a doctor, a dietitian or another professional. It must not be relied on for diagnosis or treatment, including in situations such as pregnancy and breastfeeding, diabetes, kidney, heart or liver disease, food allergy, or a condition that requires dietary restrictions.
- If you are dealing with, or fear that you are dealing with, an eating disorder, it is recommended that you consult a professional before using a nutrition tracking diary.
- Every decision regarding nutrition, drinking and health is made by you and at your own responsibility. If you have a medical question, consult a qualified professional.
4. My nutritionist
- "My nutritionist" displays nutritionists and dietitians, who are independent professionals and are not our employees. The system is not responsible for the nutritionist, their advice or their expertise; it is only a platform that allows nutritionists to join and give advice through it. We only enable the contact between you, and we are not a party to your engagement with the nutritionist, to its terms, to its price or to the advice the nutritionist gives. Any professional or financial matter with the nutritionist is between you and the nutritionist.
- Nutritionists are displayed in "My nutritionist" after they have registered, declared that they hold a valid licence from the Ministry of Health and been approved by us. They have undertaken towards us, in the Terms of Use for Nutritionists (in Hebrew), to keep your information confidential and to use it only for the guidance. Our approval of a nutritionist is not a recommendation of them or an undertaking as to the quality of their advice.
- Except for the menus provided by the nutritionist, if any, the nutritionist is not an owner and/or manager and/or partner of the app, and/or involved in any way in writing its content, and shall bear no liability whatsoever, directly and/or indirectly, in connection with the management of the app and/or its content.
- When you choose a nutritionist and send a guidance request, the details and questionnaire answers you filled in, including information about your health, are passed on to them with your consent. After sending, you can send the nutritionist a ready-made WhatsApp message containing your name and your unique code. The message is sent from your phone and your WhatsApp account, and only if you choose to send it.
- Sending the guidance request is your consent to connect with the nutritionist. The connection is created when the nutritionist approves the request by typing your unique code; if you are already connected to another nutritionist, you will be asked to approve the switch in the app. A nutritionist you contacted or who invited you can also ask to connect with you using your unique code, and in that case the connection is created only after you approve it in the app. From the moment of connection, the nutritionist can view your entire diary, including days before the connection, your values, your profile and your questionnaire answers, and can send you daily and weekly menus, sometimes with several options to choose from, instructions and voice messages. As long as a nutritionist is connected, the diary is saved in your account, even with a free account.
- A nutritionist may send the same menu to several clients, and is responsible for making sure that the menu suits you. Make sure the nutritionist knows about any medical condition, allergy or dietary restriction you have.
- You may disconnect the nutritionist at any time ("My nutritionist" → Disconnect from nutritionist). After disconnection, the nutritionist will no longer see your diary, your profile or your messages; the request details you sent them remain with them. After you decline or disconnect, the nutritionist can connect with you again only if you contact them again through the app. We may pause or end a connection, for example following a complaint or a suspected breach; while it is paused, the nutritionist does not see your diary and cannot send you menus.
- Send your unique code only to a nutritionist from whom you have requested guidance, and do not share it with anyone you do not want to connect with you.
- Joining through a nutritionist: A nutritionist may invite users to the Service by means of a personal link. Anyone who joined through the link, or who is connected to a nutritionist, will see the nutritionist's logo and details in the app, and only that nutritionist in "My nutritionist". The nutritionist may disable the AI nutritionist for users they invited or who are connected to them, except for a user who has paid for the AI nutritionist. Joining through a nutritionist does not exempt you from paying the subscription to the Service, and any financial engagement between you and the nutritionist, if one exists, is solely between you and the nutritionist. You can remove the invitation or disconnect from the nutritionist at any time, and the app will return to its regular state.
5. AI nutritionist
- The AI nutritionist is a service of an artificial intelligence model (Claude, by Anthropic). It is not a substitute for a professional, and it does not give medical, professional nutritional or any other advice, but general information only. Every piece of information is shown alongside the source it relies on. An artificial intelligence model can make mistakes, and you should check the information and consult a doctor or dietitian before changing your diet, especially if you have a medical condition or take medication.
- The AI nutritionist does not build a menu during pregnancy and breastfeeding, when there is or has been difficulty with eating, with kidney disease, when the weight is below the healthy range, or when age or sex have not been filled in; in these situations you should consult a doctor or a dietitian.
- Before the first use, you must fill in a questionnaire and accept the terms in it. The app is not responsible for anything related to allergies; you must check every recipe and every product to make sure it does not contain ingredients you are allergic to, even if you stated the allergy in the questionnaire.
- Each user has a daily quota of questions, as shown in the Service. The AI nutritionist may be available free of charge or for an additional fee, as shown in the Service; a paid add-on is subject to the provisions of section 7 and section 8, with the necessary changes.
6. Your account
Using the Service requires opening an account with an email address and a password. You are responsible for keeping your password secret and for every action taken in your account. If you become aware of use of your account without your authorization, change the password (this signs the account out on all other devices) and notify us. With a free account that does not include saving to the account, the diary is saved on the device only; we recommend saving a backup, because signing out or clearing the browser data will delete it.
7. Trial, free account and subscription
7.1 Trial period
A new user receives a free trial period, of the length shown on the sign-up screen (as of the date these terms were updated: 14 days), once per person and per email address. No charge of any kind will be made at the end of the trial period, and the account will become a free account, unless you have expressly chosen to subscribe.
7.2 Free account
The free account includes the diary with limited features, as shown in the Service from time to time (for example, without automatic breakdown, without saving to the account and without PDF reports).
7.3 Paid subscription
- Price: The subscription plans and their prices are shown in the Service before payment. Prices are stated in shekels and include VAT, to the extent applicable. Any recurring payment will be shown clearly, including its amount and frequency.
- Availability: The paid subscription will open for sign-up in the Service on a date to be announced in it. The provisions of this section and of section 8 will apply to every subscription.
- Monthly subscription: An ongoing transaction that is not limited in time. Payment is charged in advance at the beginning of each month, and the subscription renews every month until you cancel it (section 8).
- Annual subscription: A transaction for a fixed period of one year. The subscription does not renew automatically. Between 60 and 30 days before the end of the period, a notice of the end date will be sent to you, and an additional year will begin only if you expressly choose to renew.
- Means of payment: Payment is made through an external payment processing company. We do not store credit card details.
- Transaction document: After you subscribe, a document setting out the details of the transaction and the cancellation terms will be sent to you by email, as required by the Consumer Protection Law, 5741-1981 (hereinafter: the "Consumer Protection Law"), as well as a receipt for every payment.
- Price change: A price change for an existing subscription will take effect only after written notice, at least 30 days in advance, and you may cancel the subscription before it takes effect. The price of an annual subscription will not change during the year that has been paid for.
8. Cancellation and refunds
Cancellation of a transaction will be carried out in accordance with the Consumer Protection Law and the Consumer Protection Regulations (Cancellation of Transaction), 5771-2010. The provisions of this section do not derogate from any right granted to you by law.
8.1 Cancellation within 14 days
You may cancel your subscription within 14 days of the date of the transaction or of the date you received the transaction document, whichever is later, even if you have started using the Service. In that case, the amount you paid will be refunded to you, less the proportional part for the period in which the Service was provided to you until the cancellation. No cancellation fee will be charged. If you are a person with a disability, a senior citizen or a new immigrant, you may be entitled to a longer cancellation period, as prescribed by law.
8.2 Cancellation at any time
You may cancel the subscription at any time, in any of the following ways:
- Through the "Cancel subscription" link in the Service, in the "My account" area;
- By email: noaeliaz5@gmail.com;
- By phone: [Phone number];
- By registered mail to the address: 2 Weizmann St., Tel Aviv, Israel.
In the cancellation notice, state your name and the email address of the account. The cancellation will take effect within 3 business days of the date the cancellation notice is received, and you will not be charged for the period thereafter. Any amount paid in advance for a period after the cancellation takes effect will be refunded to you proportionally. At your request, the subscription can remain active until the end of the period paid for, without a refund. A written confirmation will be sent to you for every cancellation.
8.3 Refund
A refund will be made within 14 days of the date the cancellation notice is received, by the means of payment you used to pay.
8.4 Cancellation by us
If we discontinue the Service or your subscription, for any reason whatsoever, the proportional part of the payment for the remaining period will be refunded to you.
9. Permitted and prohibited use
You undertake to use the Service for personal use, lawfully and in good faith. Among other things, you may not:
- Circumvent or attempt to circumvent the usage limits, the security mechanisms or the terms of your plan, including by opening multiple accounts;
- Run automated data-collection tools on the Service, copy the shared databases or make commercial use of them;
- Interfere with the operation of the Service, overload it or attempt to break into its systems or into other people's accounts;
- Enter, in the names of foods or products, offensive or misleading content, content that infringes rights, or personal information about any person;
- Enter information in the diary about another person without that person's consent.
Each account has a daily quota of automatic breakdowns and of new product names, as shown in the Service, and in addition the automatic breakdown may be paused temporarily if the overall daily cost limit of the Service has been reached. Foods recognized from the shared database or from your diary are not counted in the quota.
10. Your content and the shared databases
- The entries in your diary belong to you. We use them only to provide you with the Service, as detailed in the Privacy Policy.
- Names of new foods you entered, value corrections you sent and names you gave to products by barcode may be included, after automatic filtering and checking and without any identifying detail, in the shared databases used by all users. A name you gave to a product by barcode is shown to other users immediately. To the extent that you have rights in this content, you grant us a non-exclusive, royalty-free licence, unlimited in time, to store it, edit it and display it to users of the Service as part of the shared databases.
- We may, but are not obliged to, review, correct, block or delete content in the shared databases.
11. Third-party services
Some features of the Service rely on third-party services, including Open Food Facts, speech recognition services and notification services of browser and device manufacturers, sharing services (such as WhatsApp and email) and the payment processing company. Their use is also subject to their own terms and privacy policies. Product data by barcode comes from Open Food Facts, an open database built by volunteers and distributed under the Open Database License (ODbL). We are not responsible for the accuracy of the information in these services or for their availability, but we will act reasonably to choose reliable services.
12. Advertisements
The Service may display advertisements, which are marked as such. The content of an advertisement, of the advertiser's website and of its offers is the sole responsibility of the advertiser, and we are not a party to any transaction between you and the advertiser. We do not pass on to advertisers any information about you or about your diary.
13. Intellectual property
All rights in the Service, including the design, the logo, the code, the texts and the way the data is presented, belong to us or to our licensors, except for your content and third-party data distributed under their licence. You may not copy, distribute or create derivative works from the Service, except for your personal use within the framework of these terms. Reports you produced from your diary are yours, and you may use them as you wish.
14. Availability and changes to the Service
We work to keep the Service available and functioning properly, but there may be interruptions, faults and maintenance work, and we do not undertake continuous availability. We may improve and change the Service and its features. If a material change is made that impairs the features included in a subscription you have paid for, we will give notice of it in advance, and you may cancel the subscription and receive a proportional refund for the remaining period.
15. Liability
- The Service is provided as is, and the values in it are estimates, as detailed in section 3. We are not liable for damage caused as a result of relying on the values, the recommendations or the reminders instead of on the advice of a professional.
- We are not liable for the advice, service or omission of an independent nutritionist you have chosen, or for the information given by the AI nutritionist, which is provided as general information only, all to the extent permitted by law.
- We are not liable for damage caused by a third-party service that does not act on our behalf, by a fault in your device or in your network connection, or by the loss of a diary saved on the device only that was not backed up.
- To the extent permitted by law, our total liability to you in connection with the Service will not exceed the amount you paid us for the Service in the 12 months preceding the event for which liability is claimed.
- Nothing in this section limits liability that cannot be limited by law, including liability for bodily injury, for damage caused wilfully or by gross negligence, or for breach of our obligations under privacy protection laws, and nothing in it derogates from your rights under the Consumer Protection Law.
16. Termination and suspension
You may stop using the Service at any time and delete your account from within the app. Deleting the account also constitutes notice of cancellation of the subscription, and the cancellation will take effect as detailed in section 8. We may suspend or block an account that is used in breach of these terms or of the law, after a warning to the extent reasonable in the circumstances. In the event of a serious breach, such as harm to the security of the Service or to other users, this may be done immediately.
17. Changes to the terms
We may update these terms. We will give notice of a material change in the app or by email at least 30 days before it takes effect. If you do not agree to the change, you may stop using the Service and cancel the subscription before the change takes effect, and you will receive a proportional refund for the remaining period. A change will not apply retroactively.
18. Governing law and jurisdiction
These terms and the use of the Service are governed by the laws of the State of Israel. Jurisdiction lies with the competent courts in Israel, in accordance with the rules of jurisdiction laid down by law, including the Small Claims Court.
19. Miscellaneous
- If any provision of these terms is held to be invalid, the remaining provisions will remain in force.
- Refraining from exercising a right is not a waiver of it.
- We may transfer the Service and our obligations under these terms to another entity that assumes them, provided that your rights are not impaired and that you are given notice in advance.
- Notices to you will be sent to the email address of the account or displayed in the Service.
